3) Medical Power of Attorney--This document allows you to appoint someone to make your health care decisions for you if you are unable to do so for yourself. It doesn't come into effect unless you are incapacitated and not able to rationally decide for yourself. Medical doctors must declare that you are not competent before the power is transferred to the person you name. 4) Directive to Physicians (Living Will) - This document allows you to decide while you are still capable of how you want your final illness to be handled. You may choose now whether to suspend useless life support efforts if death is imminent allowing you to die naturally, or you may choose to continue all medical efforts to sustain your life. This only comes into play when at least two medical doctors declare that death is imminent and that your condition is non-reversible. Regardless of the choice, the Directive to Physicians directs the doctors to keep you comfortable and with as little pain and suffering as possible. This document relieves the burden on loved ones at a very difficult time. 5) Anatomical Gift--If you wish to donate any organs to another person, science or research, this form allows your desires to be known. You have the option of what organs to donate, and for what purpose they are to be used. Many people consider this a priceless gift of life to someone else when they die. 5) What happens if I die without a will? Answer: The laws of intestate succession dictate how your estate is divided. For example if you are married with children, everything you own will go to your spouse. If you have children from a prior marriage, the estate is divided between your spouse and your children from the previous marriage. The rules vary depending on whether the property is community property or separate property, and whether the property is real property (land and anything permanently attached to the land), or personal property (everything else). A spouse will never be kicked out of the family residence. 6) Can Estate Planning save money for my loved ones? Answer: Yes. Tax planning is an integral part of estate planning. |
