1) Who can get a divorce? Answer: In Texas, either spouse may seek a divorce. Filing an Original Petition for divorce begins the process and starts the clock moving. Aside from attorney's fees, the court requires a filing fee. 2) Can I Change My Mind After I File for Divorce? Answer: Yes, you can rescind your original petition anytime prior to the the divorce becoming final. There is no cost to rescind a divorce. 3) How Long Does it take to get a divorce once the Original Petition is Filed? Answer: That is a tough question. The minimum time frame to finalize a divorce is 60 days after the original petition is filed. However, depending on the complexities involved (houses, children, businesses, etc.) it could be much longer. 4) I Just Moved to Texas, Can I Get a Texas Divorce Now? Answer: You must be a Resident of Texas for 6 months and your home (domicile) must be in the county where you file for a minimum of 90 days 5) If I'm Common-Law Married, do I still need to get a Divorce in the Court? Answer: Yes. There is no such thing as a common-law divorce. 6) Does Texas have a No-Fault Divorce? Answer: For all practical purposes, Texas does have a no-fault divorce called "Insupportability". Without blaming either spouse, you contend that because of discord and conflict of personalities, the legitimate reasons for the marriage have ended. |
