7) Who Gets the House and Cars and How do we Divide Our Stuff? Answer: If the spouses can agree on how to divide the community assets, the court will generally agree. However, if the spouses can not agree, the court will divide the assets using the rule of law called "Just and Right" division. In the courts discretion, the court will do what the court feels is just and right under the circumstances. 8) What if one spouse caused the divorce? Answer: If the court finds that one spouse is at fault and caused the divorce, the court may award a disproportionate share of the community assets to the spouse who was harmed. The court may also award attorney's fee to the innocent spouse. 9) What are some of the reasons that my lead the court to rule that the divorce was my spouse's fault? Answer: Common reasons for fault in a divorce include cruel treatment, infidelity, abandonment and others. 10) I'm concerned that my spouse will empty the bank accounts or sell our stuff while the divorce is pending. Is there anything I can do? Answer: Yes, the court will usually issue an immediate temporary restraining order, and after a hearing issue a temporary injunction, making it a criminal offense for either spouse to inappropriately dispose of community assets. 11) What if there is a history of Family Violence. Can I do anything to protect myself and my children? Answer: Yes, the court may issue a protective order commanding any police officer to take into criminal custody anyone who violates the order. The order will require that the offending party refrain from the behavior complained of when the order was issued. |
